Judgment Enforcement

Most creditors believe that once the judgment is awarded in their favor, all the hard work is done. That may be true if the objective during the litigation process was simply to show a win for the creditor. In reality, the creditor wants to be compensated and a judgment award symbolizes the creditor’s right to payment. It does not, however, ensure payment.

More often than not, debtors avoid their repayment obligations. When the debtors refuse to pay, the process of enforcement is key to receiving payment on the award. Once enforcement begins, the award becomes a powerful tool used in transforming the paper judgment into actual funds.

New York State allows liberal enforcement of judgments. Choosing the right enforcement professional is paramount to successfully collecting on the judgment award. Shnaider law works with both businesses and individuals to take control of the process. After building an exhaustive profile of the debtor, we determine the most advantageous asset and method available for use in recovery. In conjunction with our advanced investigation tools, we employ the use of as many New York State allowed judgment enforcement techniques as necessary, including, but not limited to:

  • Garnishing wages,

  • Restraining various monies belonging to the debtor,

  • Attaching liens on real property,

  • Seizing assets through the use of a Sheriff or Marshal,

  • Liquidating assets for cash,

  • Forcing the sale of real or personal property,

  • Commencing actions for turnover and more.
